Terms of Service

About Wapas

Wapas ("we", "us", "our") is a digital loyalty stamp platform operated by Wapas (Private) Limited, incorporated in Pakistan. Wapas enables restaurants and food businesses ("Restaurant Accounts") to run digital loyalty programmes for their customers ("Customer Accounts") through QR code scanning, digital stamp cards, and automated re-engagement campaigns.

By accessing or using wapas.me or any related service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the service.

User Accounts

To create a Restaurant Account you must provide accurate registration information and keep it up to date. You are responsible for all activity that occurs under your account. You must not share login credentials or allow unauthorised access.

You must be at least 18 years old and have the legal authority to enter into a binding agreement on behalf of the business you register. If you register on behalf of a company, that company accepts these Terms.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.

Restaurant Accounts

Restaurant Accounts can create loyalty card programmes, issue digital stamps, set reward rules, and send win-back campaigns to their customers. You are solely responsible for:

  • The accuracy of all campaign content and offer terms you create
  • Honouring rewards and offers displayed to customers
  • Complying with Pakistan's Consumer Protection Act and all applicable laws
  • Obtaining any necessary permissions before sending WhatsApp or push notification messages
  • Ensuring your staff use stamp-issuing features appropriately and without fraud

We are a technology provider only. We are not responsible for disputes between you and your customers regarding loyalty rewards, offers, or refunds.

Customer Accounts

Customers join a restaurant's loyalty programme by scanning a QR code and providing their phone number. By joining, customers consent to receive loyalty-related communications (stamp confirmations, reward notifications, and win-back messages) from that specific restaurant via the Wapas platform.

Customers may withdraw from a restaurant's programme at any time by contacting the restaurant or by reaching us at hello@wapas.me. Customers are not billed by Wapas.

Data and Privacy

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using Wapas, you consent to the data practices described therein.

Restaurant Accounts act as data controllers for their customer data collected through the Wapas platform. You must have a lawful basis for processing customer data and must handle it in accordance with applicable Pakistani data protection law.

Acceptable Use

You agree not to use Wapas to:

  • Send unsolicited bulk messages (spam)
  • Engage in fraudulent stamp issuance or reward manipulation
  • Attempt to access other accounts, systems, or data without authorisation
  • Reverse-engineer, scrape, or otherwise extract data from the platform
  • Transmit malicious code or disrupt service availability
  • Violate any applicable Pakistani or international law

Intellectual Property

Wapas retains all rights to the platform, software, design, and branding. You retain ownership of your own business data (customer lists, campaign content). You grant us a limited licence to process your data to provide the service.

You must not use the Wapas name, logo, or trademarks without our prior written consent.

Fees and Payment

Wapas may offer a free tier and paid plans. Paid plan fees, billing cycles, and refund policies will be communicated at the time of upgrade. We reserve the right to change pricing with 30 days' notice. Continued use after notice constitutes acceptance of the new pricing.

Limitation of Liability

To the maximum extent permitted by Pakistani law, Wapas and its directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the service, including but not limited to lost revenue, lost customers, or data loss.

Our total aggregate liability for any claim relating to the service shall not exceed the amounts you paid us in the three months preceding the claim. If you have not paid us anything, our liability is limited to PKR 10,000.

Termination

You may close your account at any time by contacting hello@wapas.me. We may suspend or terminate accounts at our discretion with reasonable notice, or immediately if there is a serious breach of these Terms.

Upon termination, your right to access the service ends. We will retain data as described in our Privacy Policy and delete it according to our retention schedule.

Changes to These Terms

We may update these Terms from time to time. We will notify Restaurant Account holders by email or in-app notification before material changes take effect. Continued use of the service after changes constitutes acceptance of the updated Terms.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Pakistan. Any disputes arising from these Terms or your use of Wapas shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.
